Summer is winding down in the Great Lakes State. HVCC is near the end of its run - but its progeny will live on forever in dozens of entities, departments, bureaucracies and rules. On July 21st the President signed into law the Dodd-Frank Wall Street Reform and Consumer Protection Act. This bill represents a significant overhaul of the regulations regarding America’s financial services sector. Since the beginning of the legislation NAR has work hard on behalf of real estate agents and appraisers to make sure the interests of REALTORS® are protected in this historic reform. Included in the lengthy and complex reform bill are a handful of significant changes for the appraisal industry. Among these changes are a few efforts directly aimed at correcting some of the unintended consequences of the Home Valuation Code of Conduct (HVCC). In particular the legislation requires that appraisers be compensated at a rate that is “reasonable and customary” for appraisal services in the market area of the property being appraised, and a sunset of the HVCC upon new interim regulations by the new Consumer Financial Protection Bureau.
